DUNCAN LAKES RECREATIONAL VEHICLE RULES & REGULATIONS
Adopted September 11, 2007

These rules & regulations are not meant to replace the parental responsibility in deciding if their children and/or quests are responsible enough to safely handle and drive a recreational vehicle.

ATV CLASS

By definition, ATV (All Terrain Vehicle) is designed for off road use. They range in size from 50cc to 1000cc and may be 2 wheel drive or 4 wheel drive. The smaller ATV's are usually for younger kids. The leaseholders are the judge of what their children and guests can handle and drive safely. These rules are not to replace the leaseholder's responsibility for the safety of their children and guests.

Operators and passengers less than 12 years old must wear a helmet, unless they are accompanied by a responsible , licensed to drive adult. No more than two people may be on an ATV at a time.

UTILITY ATV CLASS

By definition, UTV (Utility All Terrain Vehicle) is designed for off road use, side by side seating, and have a utility box for hauling items or additional seating. They range in size from 300cc to 1000cc and may be 2 wheel drive or 4 wheel drive. Also included in this class is the eight wheel amphibious UTV. The leaseholders are the judge of what their children and guests can handle and drive safely. The leaseholder will also make their own decision as to whether their children and/or guests will wear a helmet. These rules are not to replace the leaseholder's responsibility for the safety of their children and guests.

GOLF CART CLASS

By definition, golf carts are designed for road use only. They are either gas or electric powered and usually only have forward and reverse and a governed top speed of less than 20 mph. The leaseholder is the judge of whether their children and guests can handle and drive safely. The leaseholder will also make their own decision as to whether their children and/or guests will wear a helmet. These rules are not to replace the leaseholder's responsibility for the safety of their children and guests.

GENERAL RULES

Control of all Recreational Vehicles shall be maintained at all times, hand signals shall be used and yielding of right-of-way shall be observed. Reckless driving, displays of acceleration, spinning tires and turning of donuts on the roads shall not be tolerated. Spinning of tires and turning donuts that create bowls and damage the surface on dyke trails shall not be tolerated.

Any driver observed not obeying speed, yield signs, right of ways, driving on the wrong side of the road will be stopped. See penalties.

No RECREATIONAL RIDING on Duncan Lake Property is permitted after 10 P.M.

Operating hours for under the age of 21 are from 8 A.M. to 8 P.M. Memorial Day to Labor Day the hours are 8 A.M. to 9 P.M.

Recreational Operating hours for over the age of 21 are from 7 A.M. to 10 P.M.

All Recreational Vehicles must have operating headlights and taillights for night driving.

Only three (3) recreational vehicles allowed, includes ATV, UTV, Razr’s, or Golf Carts per lease are permitted, regardless of how many families share the lease. Leaseholders with multiple leases or lots are still only allowed three (3) recreational vehicles.

All Recreational Vehicles must be registered with the DUNCAN LAKES IMPROVEMENTS ASSOCIATION and/or it successors and adhere to the DUNCAN LAKES RECREATIONAL RULES & REGULATIONS.  And have their Lake Sticker displayed on the front & rear plate of the vehicle.

Recreational Vehicles that have performance enhancing equipment or loud exhaust pipes are not allowed.

Recreational Vehicle operators must obey posted speed limits. All Duncan Lake roads are 10 miles per hour, except Cedar and Firefly, which are 20 Miles per Hour.

PENALTIES

The ATV Committee will administer penalties to violators of the above mentioned rules.

Violations of the above rules and regulations could result in the following:

FIRST PENALTY - Two week suspension.

SECOND PENALTY - One month Suspension.

THIRD PENALTY - One year suspension.

FOURTH PENALTY - Permanent Suspension.

However, all warnings and penalties will be decided and administered by the ATV Committee based on the severity and frequency of the violations and will remain on file for two years.

Loss of Recreational Vehicle privileges applies to the entire leaseholder(s) family and their guests. No Recreational Vehicles can be used during the suspension period. Recreational Vehicles operated during suspension will have their original suspension duration doubled.

The leaseholders are responsible for the conduct of the operation of their Recreational Vehicles. Misconduct by any operator, will result in disciplinary action to the leaseholder.

REMEMBER THE FIRST AND MOST IMPORTANT RULE, ALWAYS BE SAFE.

REGISTRATION

Proof of ownership and liability insurance of at least $50,000 is required.

All Recreational Vehicles will be assigned an identification number plate. All recreational vehicles must have this plate affixed to the front and rear and it must be visible during operation. The yearly sticker is to be applied to the rear plate.

All Recreational Vehicles must be registered by June 1st with the DUNCAN LAKES IMPROVEMENTS ASSOCIATION. Registration fees for dues paying association members are $10.00 ($20.00 after June 1st). Registration fees for non dues paying association members are $40.00 ($50.00 after June 1st). Registration fees are per Recreational Vehicle.

Identification plate replacement fee is $5.00 per plate.

Leaseholders may register their Recreational Vehicles by sending the proper fees (including association dues and donations) along with signed release and indemnity agreement signed by leaseholder, and proof of insurance for vehicles to: D.L.I.A. (ATV), PO Box 21, Duncan, NE 68634 along with a SASE for the return of the sticker. New Recreational Vehicles must be registered with the ATV Chairman.

DUNCAN LAKES LLC, do hereby authorize the DUNCAN LAKE IMPROVEMENTS ASSOCIATION and/or its successors to enforce the above rules & regulations for Recreational Vehicles at Duncan Lakes.

Attention all ATV owners and riders:

We have to stop creating bowls on the dikes, it not only weakens the dike, it is dangerous to all ATV riders. I feel we must stop the doughnuts on the dike trails as well. That starts the bowls! I have talked to some of the young riders and asked them to find someplace away from the "traffic areas" to make their bowls. Someplace where it won't hurt the dike and will not create a dangerous area to other ATV riders.

I don't think the problem is entirely with our "young ATV riders" totally, not naming any names.

So please, ATV riders young and old, show some consideration for others. Ride responsibly, cause it could stop ATV riding period.
