BOATING RULES

Only boats owned by Duncan Lakes Lessees or deeded lot owners which are registered in the name of the Lessee or deeded lot owner and have a current Nebraska license will be allowed on the lake. The only exception is a boat that has had written permission of Duncan Lakes, LLC. Prior to 7-10-2007. Each Lessee or deeded lot owner may have a maximum of two class I boats. All boating shall be at the participant's risk. Duncan Lakes, LLC. The Duncan Lakes Improvement Association and the Boat and Water Quality Committee, shall under no circumstances be responsible or liable for an injury or damage, which may occur.

Anyone that has two (2) Class one (1) boats will have to get rid of one by May 2017.

CLASS I

A - INBOARD MOTOR BOATS

No inboards allowed.

B - OUTBOARD MOTOR BOATS

1) Outboard motor boats shall be no longer than 17'6" in length.
Boats over 17'6" will be allowed if approved prior to 7-10-07.

2) Outboard motor boat engines can be no larger than 75 HP.

C- PONTOON BOATS

1) Pontoon boats shall be no longer than 20' in length.
Boats over 20' will be allowed if approved prior to 7-10-07.

2) Pontoon motor boat engines can be no larger than 75 HP.

CLASS II

A-15 HP OR LESS GAS POWERED AND ELECTRIC POWERED BOATS

1) Boats shall be no longer than 20' in length.
Boats over 20' will be allowed if approved prior to 7-10-07.

CLASS III

A- All Non-Power Boats:

1) Row boats, Paddle boats, Canoes, Kayaks.

 Class IV

A-Not considered a motor boat.
1) A fiberglass/plastic boat 8 feet or under that can’t hold a gas motor, but can have a trolling motor on it.  This boat still needs to be registered with theState of Nebraska, have insurance coverage, and registered with the Lake Association for stickers.

BOAT REGISTRATION: All class I and II boats will have to be registered and show proof of Insurance each year. Class III boats have to register and show proof of insurance to get the first sticker. A new class I or class II boat registering for the first time will need to be inspected by a member of the Boat and Water Quality Committee to receive its first sticker. To renew your class I or class II boat registration or register a class III boat. Boat has to be registered and insured in the leasee name.  Need boat registration and proof of Insurance in order to get the sticker.  Send the appropriate class fee along with proof of insurance, a signed indemnity agreement and a Self Addressed Stamped Envelope (for the return of the boat sticker) to: DLIA, P O Box 21, Duncan, Ne 68634.

Registration Fees Class I :
$80.00 Duncan Lake Association dues paying member.
$110.00 Duncan Lake Association non dues paying member.

Registration Fees Class II:
$10.00 Duncan Lake Association dues paying members.
$40.00 Duncan Lake Association non dues paying member.

Registration Fees Class III:
$5.00 Onetime fee Duncan Lakes Association dues paying member.

Registration Fee Class IV:
$10.00 Duncan Lakes Association dues paying member 

BOAT IDENTIFICATION:  All boats will receive identification stickers when they are registered. All class I and II boat stickers will be renewed on an annual basis upon showing proof of insurance. Class III boats will also need identification stickers, but they will not need to renew annually and will only need to replace stickers if lost or unreadable. Identification stickers shall be placed one on each side, around the middle back half of the boat. The stickers will need to be visible from the shore line on each side. They should be maintained so as to provide clear legibility for identification.  These stickers can be obtained from the Boat and Water Quality Committee.

INSURANCE: All boats with electric or gas motors operated on the lake will be required to have water craft liability insurance in an amount not less than (300,000.00) per boat. All non-power boats (row boats, paddle boats, canoes and kayaks) will be required to have liability insurance in an amount not less than (50,000.00) per boat. Proof of insurance will be required before any such boat will be allowed on the lake.

BOATING TIMES:  FAST BOATING: May 15 through September 15 - Full speed boating 10:00 a.m. to 8:00 p.m, northeast section of the lake only.

NO WAKE BOATING: For the rest of lake in effect except as provided.

BOAT OPERATION: 

1. ALL AREAS OF THE LAKE: All powered boats shall at all times give right-of-way to non-powered boats. When two boats are approaching each other in a head-on manner, each boat shall bear to the right.  No boat can overtake another boat in a connecting canal. If one boat overtakes another on the lakes, the overtaken boat stays to the right and yields the right-of-way.  No person shall anchor a boat for fishing or any other purpose in such a way as to obstruct a passageway ordinarily used by other boats.  No person shall operate any boat while under the influence of intoxicating liquor or drugs. No operator of any powered boat shall have in his possession or be consuming alcohol while in control of the boat.

2. FAST BOATING \ WATER SPORT AREA: The accepted traffic pattern in the water sport area, (Northeast section of lakes) is to stay to the right and go in a counter clockwise direction. No boat shall go clockwise in the water sport area during fast boating hours. When there are water sports activities going on, fishing boats and boats that can not keep up with the flow of traffic are to stay out of that area. All boats shall and must at all times give the right-of-way to boats engaging in water sport activities Each Lessee or deeded lot owner must see that these provision are not violated by their guests. Every operator shall at all times navigate his boat in a careful and prudent manner.

NO WAKE:  This is as slow as your boat needs to go, so that it will not create any wash to the bank of the lake.  If you are operating your boat in such a matter that you are creating more wake and washing then is necessary, you may be subject to having your boating privileges suspended.  NO WAKE = SLOW DOWN

BOAT CAPACITY:  All owners shall limit passenger load to their boat's rated and safe carrying capacity.  Overloaded boats create large waves and cause damage to the bank.

AGE OF BOAT OPERATOR:  No minor under 16 years of age shall operate a boat equipped with more than a 15 HP motor unless accompanied by a Lessee or deeded lot owner or a member of their immediate family who is at least 16 years of age.  No one under 14 years of age shall operate motor boats of any class at any time whether accompanied by an adult or not.

GUESTS:  Guests may swim and boat in the common-use waters only when accompanied by a Lessee or deeded lot owner or a member of the immediate family.  Guests may ride in or operate power boats of Lessee or deeded lot owner on said lakes only when accompanied by a Lessee or deeded lot owner or a member of their immediate family who is at least 16 years of age.  Guest drivers must be 18 years old.  A guest driver who is at least 18 years of age towing a Lessee or a deeded lot owner or a member of their immediate family who is at least 16 years of age on skis or surfboard will be complying with this rule.

 EQUIPMENT:  All skiers and surf boarders must wear life jackets and tow ropes must not exceed 75 feet.  All riders on inflatables, including tubes, must wear life jackets and tow ropes must not exceed 40 feet.  Tow boats must use an observer when three or more tow boats are using the lake.  At all other times, tow boats must use either an observer or rear view mirror.  Whenever a waterskier, surf boarder, or any person engaged in a similar activity or associated equipment is down in the water, the operator or observer of the tow boat must display a hunter orange flag. The size of the flag must not be less than 12 inches square or at least 144 square inches and the flag must be visible 360 degrees. All boats must carry oars and efficient whistle or bell. A fire extinguisher must be in any boat that has an enclosed or built-in gas tank.  All riders in any water craft who are 12 years of age or younger must wear a life jacket and a life jacket must be in the boat for each rider older than 12 years of age.

BOAT LIGHTS:  After dark, when a motor boat is in motion, it must show a bright white light to the stern and a combination light to the bow, showing green to the right and red to the left.

STATE BOATING REGULATIONS AND DUNCAN LAKES RULES:  All boats and operators will comply with the State Boating Regulations and Duncan Lakes rules provided.  However, if the Duncan Lakes rules are more restrictive than State Regulations, then all boats and operators shall comply with the Duncan Lakes rules.

STATE ACCIDENT REPORT:  If you have more than $100 damage to your boat because of some type of accident, you must fill out a State Accident Boating Report.   

THE BOAT AND WATER QUALITY COMMITTEE: The Boat and Water Quality Committee has the authority to suspend the lake rights of any person who continually breaks rules or causes danger to other people.  Any problems or concerns you have may be directed to this board. SAFETY ON THE LAKES is everyone's concern and responsibility.  If you see a violation of these rules or any activity that may be dangerous or hazardous, please tell the individuals that they are committing a violation or contact a member of the Boat and Water Quality Committee. Violations of the above rules and regulations could result in the following:

FIRST PENALTY - Two week suspension

SECOND PENALTY - One month suspension

THIRD PENALTY - One year suspension

FOURTH PENALTY - PERMANENT SUSPENSION

However, all warnings and penalties will be decided and administered by the Boat and Water Quality Committee on behalf of Duncan Lakes, LLC. Based on the severity and frequency of the violations and will remain on file for two years. Loss of Boating privileges applies to the entire family and their guests on all their boats. The boats cannot be used during the suspension period. A boat operated during a suspension period will have the original suspension doubled.

Duncan Lakes, LLC. Hereby grants the authority to the Duncan Lakes Community Association's, Boat and Water Quality Committee to enforce these rules and regulations.

Its been brought to my attention some people here at the lake are not registering their boats with DLIA. They run the risk of losing their boating privileges. I for one would have no qualms in telling someone to pull their boat out, after all I pay my fee!

If you know someone with an unregistered boat, tell them to pay up.
